Iowa governor signs bill expanding powers of state gaming regulators

Iowa Gov. Kim Reynolds has finalized a law that puts the Iowa Racing and Gaming Commission on par with many other state gaming regulatory agencies in terms of its enforcement authority. As a result, there are two ways that the commission could seek to restrict the operation of online sweepstakes casinos in Iowa.

The new law does not specifically target sweepstakes casinos, but they could be among the targets of actions from the commission with its new authority. Support for those actions will still require cooperation from Iowa’s judicial system.

SF 2289 empowers IRGC to censure unlicensed gambling websites

Reynolds signed Senate File 2289 on May 15, making the bill law after the legislature approved the measure on April 28. With the law in place, the Iowa Racing and Gaming Commission (IRGC) is a much more formidable agency in terms of enforcing the state’s gambling laws.

Prior to the enactment of this statute, the IRGC could only sanction licensed parties for infractions of Iowa’s gaming laws and regulations. Now, the IRGC can take two actions against unlicensed operators as well.

The IRGC can send cease-and-desist orders to companies and individuals that it believes are offering gaming to people in Iowa without a license. Additionally, the IRGC can ask state courts to compel compliance with those orders via a formal injunction.

Law enforcement in the state and the courts still adjudicate potential criminal penalties for violations of Iowa’s gambling laws. However, the IRGC can refer unlicensed gambling to the Iowa attorney general for possible prosecution.

Sweepstakes casinos may be among the first targets of these new actions by the IRGC. There may be room for recipients to challenge those actions, though.

Status of sweepstakes casinos in Iowa depends on interpretation of gambling statutes

Iowa law does not explicitly mention dual-currency systems or sweepstakes casinos. The Iowa Code restricts legal casino games to licensed brick-and-mortar facilities, though.

That legal precedent is what IRGC cessation demands for sweepstakes casinos will likely be based upon: the lack of licensure and the illegal status of online casino games in Iowa. The counterargument from sweepstakes casino operators, though, would pertain to Iowa’s definition.

Recipients of cessation demands from the IRGC who operate sweepstakes casinos could claim that their games don’t fit the definition because players can access them by risking free digital currency, thereby eliminating the consideration element necessary to qualify the games as gambling.

That situation could explain why the new law includes a provision allowing the IRGC to seek injunctive relief from state courts. By doing so, the courts could establish a precedent that characterizes sweepstakes casinos as a form of gambling under current law.

Should the question of whether sweepstakes casinos qualify as gambling under Iowa law arise, the Iowa attorney general could weigh in as well by offering an official opinion. That could be a precursor for actual prosecution of an entity that doesn’t comply with a cessation demand from the IRGC.

Such prosecution has not yet occurred anywhere in the U.S., although the new law could set Iowa on a path to become the first venue for such legal wrangling. If that possibility does not occur, prominent sweepstakes casino operators should expect to receive cessation demands from the IRGC in the near future.
